No Brad they dont want anything to do with it, i went down to the local cop shop and they told me no injury no need for them to visit. I gave them a mouthful about double standards, the lady across the road heard him doing a burnout but they still dont want a bar of it.
I did find out he lives 2 streets away is 21 and has only had the ute in his name for 2 months, there is drugo house in the corner of my street and he was seen leaving there showing off.
Now i just have to wait to see what happens insurance wise.

I have contacted the police by phone and also been to the station, Tumbo has given me some advice so will see what happens in the morning. My Brother-In-Law is a panel beater and is going to have a look in the morning, but going off previous cars i have seen with similar damage it will be around the $5000-$7000 mark depending on how much they have to pull the rear.
What really gets me is i know the car will never be the same again. :(

I'd be sending them the bill for the whole amount, why should you have to wear it because they choose to be a clown....

Yeah they do, but they are going to try and commit fraud by saying there where witnessess to the accident in the car when i have been advised there was no body ele in teh car with the driver. Seems like its going to get very messy for this guy, i just hope it doesnt turn out that way for me.

All insurance Companies chase as they don't want to pay any more than they have too.
I had a clownette clean up my Bus in her Brand New Mazda 6 Series, writing it off, 50k worth of car. She hit my rear wheels, slid under the Bus to within 1cm of the Chassis, lifting & shifting the Bus 2.5m before dropping me on the median strip.:mad:
The insurance co chose to chase me for the costs as my name appears on the Police report as the driver of the other vehicle. I told them to Jam it :mad: where it fits
The Police have not charged me, in fact they have given me a letter stating that they have not charged me, to shove in the insurers face, as my employers insurance won't pay either (the Police can't determine who was at fault, go figure?:confused:).

He is a bit particular, as he has been burn't by insurance companies before, but I can ask if you like. She has had a fair hit, but it is amazing how well they can fix them these days.

Mate if you could that would be great as the car is sitting in my driveway till i talk to the insurance company tomorrow.
By my rough look its going to need right rear 1/4 panel, boot lid and garnish, rear bar , left rear wheel ( yes he pushed it that hard against the gutter ) left rear suspension, beaver panel , rear section of exhaust , boot floor pulled and that from what i can see before it pulled apart.
The sad thing is it will just never drive the same, they never do after a hit like that :(

Without wanting to sound like a naysayer, my car copped a massive whack a few years ago, every panel from the rear doors back replaced, mechanicals needed fixing - drives better now than it did then...
As long as they do a thorough job, it may come good for you.

I hope you don't end up wearing the cost of someone elses stupidity.
Be very careful to document EVERTHING when dealing with Insurance Companies.
As a Bus Driver, I had to involve the police & they had to attend as I had 8 children on board at the time of my accident.
Does your Mobile have a recording capacity? If so use it. Anything said by these lowlifes may be useful, if not with the Police, then with your Insurance Co. BTW, I hope you do succeed in getting them for fraud.
Its good that you've already sought good legal advice.
As I illustrated, one Company started to chase me until I started to lecture them about the Privacy Act, & that I would institute proceedings unless all harassment ceased immediately as the accident was in the hands of the insurers & they were using information contained in a Police report contrary to the provisions of the Privacy Act.

I would also record all conversations you have with the bloke and his mother, especially if they seem to be lying about how many people were in the car. There's normally a record button on the later mobile phones (if you have one) you can use. Good luck.

My understanding is that in some circumstances you can't record people without their knowledge...hence why when you ring organisations they say that they are going to record you...I know at work I have to tell people before I hit record, so I don't bother recording, I make notes instead, dated and if I think it's gonna come back, signed and filed...as these are admissable...well that's the advice I've had anyway.
IIRC, phone taps have to have court approval before they are done so that they are then admissable...
As I said, Tumbo may know what you can and can't do with regards to recording phone conversations...
Thinking about it though, it could be worth saying "I'm recording this conversation" and see what they say;)

Recording of Phone Calls is dealt with in the Telecommunications Act however, I wasn't referring to recording a phone conversation merely a conversation which some mobile phones have the facility to do.
BTW, if you let the other party know they may be recorded you are not committing an offence.
Why do you think the Insurance Co & Govy Depts do it, even Telstra
Cheers fellas. I could see how having to tell the person you're going to record the phone call wouldn't exactly work out the way you would want it to :D

I too have experienced this. The little twerp didn't have insurance and wanted me to take it up and them cover excess. Dont these clowns think about the cost of next years insurance when it goes up because you claim.
I was lucky to know someone that knew him, got his details including drivers licence number. I put claim in with my insurance and they chased him for the money. Got car back, pretty good job. Even got stereo fixed after it stopped working after the wack.
So if you have his details, do a claim and just note he was the driver, but I think you will need his license number as well as name and address.

What a bummer Luke .. Hope it all works out ... Its not only a hassle getting the dollars for the repairs its the dam inconvenience of having y're car off the road AND the fact that it is now tainted simply because you know it has been crunched. Cars can be fixed tho' - just gotta find a good repairer :o.

Well have a restless nights sleep i will be on the phone to the insurance company this morning to see what to do.
Regarding the conversation i did advice the guys mum that i was in fact recording it to which she to put it politly cr**ped herself, i was told he was changing a CD but that must have been whilst the car was at a 45 degree angle to the gutter.
Seems like this fun exercise in patience :rolleyes:

I know before I was 25 basically no insurance company wanted to know about me & a V8 or turbo charged engine, so hence I waited until I was old enough to get something I was prepared to pay....

The recording will only work in a bluff factor. The best thing you can do is record it, don't tell anyone, and then take detailed notes (not too detailed;)) from the recording. That way you can concentrate on the discussion and not try to take notes at the same time.
But as has been said, best to handball over to the insurance mob. Remember, its their money so they will do all they can to get your new mate to pay for it..

I'm pretty sure you only need license plate number, and his name and address (cause of unlicensed drivers;))...it'll be in the policy anyway.

Not going to bother telling the idiot that hit me anything, i advised them that its going through insurance and that if he is not insured then he can fight it out in court with them.
With what i have found out about him though i reckon he will be in debt for a very long time.

My wife used to drive around with a sign on her car saying "Hit me" Got hit about 5 times in 8 years. Never her fault. Always stationary, parked or side swiped. Most people wanted to pay cash so it didn't go on their insurance record. A couple didn't cough up in time so the insurance company were informed and because of the circumstances the cars were always fixed at no cost to us. Some of the people weren't happy but we gave them every chance to cough up before going through insurance. If there is no fault to you then your rating etc should be fine.
Worst case I heard was a woman my wife worked with. Driving her husbands recently restored XA Fairlane to work, had a woman in a brand new VT park in the back of her at high speed. Wrote both cars off and the woman in the VT was uninsured, had the car less than a week and no cover note. They got the money for the XA but it was never going to pay for all the hard work that the owner put into it.

Given the record i have been informed he has i am not surprised he doesnt have insurance, what gets me is the car he purchased is on finance and they normally require full comp insurance before they allow you to take the car.

Most only view such documentation in the year the vehicle/finance is purchased & then after that it's your responsibility to maintain it as a condition of the finance.....
I know my bank used to annually remind me (when I had various car loans)of this in the form of a letter, but not once in any of the subsequent years did they ever check up to see that the insurance was continued ;)

Awful. Frustration, annoyance, hassle, expense, but thankfully no injuries. This time. THIS is why I have serious issues with burnouts, speeding, drink driving, careless driving, arms out of the window etc. Eventually someone gets hurt, financially or physically........
I hope it gets sorted out, but how is it people can live their lives like this, with no regard for anyone else?

I spoke with said driver and lets just say i have laid down home truths about his driving, i got a hold of the insurance company who suggested that he can do a payment plan to get out of the poo and not go to court to recover the debt in 1 hit.
I think this has scared the you know what out of him, i learnt he has lost his licence for traffice offences a few times but this might finally be the one thing that slows him down ( 1 can only hope ) next step for me is to get the car to the repairer of my choice and get it repaired right first time with everything being as or better than new.
Not quite in your league Luke but I got back to my car last night after work to find some idiot who also obviously can't drive has scraped right along the front right hand side of my front bumper and guard.
It's nowhere near $7000 worth of damage but the annoyance and frustration is on a par knowing that some tosser can't even park their car properly without hitting someone else. This is also the second time this has happened and no, they didn't leave a note.:mad:

Nearly as bad as the stroy i got the first time i went to Willowbank with the Datto. That a young kid was out there in a BMW 318i nice and new, didnt pump up his tyres on the 2nd or 3rd lap go it a bit sideways the tyre rolled off the rim and he rolled the car, big problem was it was his mum's car and she thought he was out shopping :o
Well the idiot that hit me has done the descent thing and owned up to being at fault ( well his mum did it ) so i dont have to pay an excess and the car is getting fixed by company in Brisbane the are the recommended repairer for BMW.
Will get some photos as it being done hopefully.

Well the car is at the panel beaters and first indications are that they will repair it, i spoke to the head guy at the panel shop who is estimating a repair bill of $15,000 ( yes that is 3 zero's ) at this stage.
I am going to get some pics of it pulled apart and can go there to look for myself at any stage ( which i think is great as it shows they having nothing to hide and are confident of there work ) to see the car stripped.
The list is amasing so far:
Right Rear Quarter Panel
Boot Floor
Left Rear Suspension
Boot Lid
Dog Bone
Beaver Panel
1 Rim ( maybe tyre too )
K frame
and numerours other bits which i cant even remember.

Price looks about right, we had the whole right side of our VT's body from the hip down replaced, along with front front bar, side skirt, a rim and a tyre as well a complete respray of that side of the car and that amassed to $8000:eek:.

I spoke to my insurance company today, the estimate finally came through on Friday and its more than first expected, $16,800 at present and could possibily go higher.
One good thing though they asked what my thoughts were, i said i was concerned where part of the reapir was going to take place and the potential about there being problem should the car get hit there again, by the responce i got they seemed to agree.
Just have to wait till an assessor goes to view it in person before i findout what the final outcome will be either repair or writeoff, but writeoff is really starting to be seriously considered by the insurance company.

Yeah its good Brad, not just financially but also for piece of mind. Given where the damages is and what they are going to have to do to repair it i hope it is a writeoff.
If it is then im not sure what i am going to do, maybe a new ESeries or maybe a VE-SSV with everything as i can get both a mates prices :D

While you may be a little disappointed in not getting it written off, at least the good news is that something is finally being done about it ;)
If it's being done at the right place (which I assume you would have organised) then no one should be able to tell it's even been damaged once the repair is completed....the worst bit & most frustriating I'd suggest is not having your pride & joy for such a long time due to no fault of your own.

Not having it doesnt really worry me as i dont drive it that much anyway ( 7200 ks in 12 months ) but the missus has said to drive the wheels of it when i get it back to make sure its all good, because if its not it will keep going back till its right.
